Certification

This is when the translation of a document is sworn to be accurate. It is requested any time the translator must officially certify that the translated text corresponds to the original.

The translation and certification must be done by an official translator.

  • When a document from a foreign country is written in a foreign language and needs to be legally valid in Italy.

To certify a document or translation, only a certified translator registered with the court releasing the official translation need be present.

The time needed for certification is about one week from the date the task is assigned.

Legalization

Legalization comes after certification. It is required when a translation must be legally valid in a foreign country that does not participate in the Hague Convention of 5 October 1961 (for countries that have signed the Convention, see the definition of ‘apostille’).

It is done at any Italian public prosecutor’s office.

FAQs

  • If the document is translated from a foreign language into Italian because the document must be used for legal purposes in Italy, no form of legalization following certification is necessary.
  • If, however, the document translated and certified by an official translator must be used for legal purposes in another foreign country, the certification must be legalized at the same court where the translator certified the translation.

The time needed to legalize a translation at the court is about 2–3 working days.

Apostilles

The apostille replaces legalization for countries that have acceded to the Hague Convention of 5 October 1961 concerning exemption from the legalization of foreign public acts. The apostille is a specific annotation, a special stamp that attests to the authenticity of the document and the legal attributes of the issuing authority. The updated list of countries that have ratified the Hague Convention and the authorities qualified to apply the apostille in each country are available on the website of the Hague Conference on Private International Law: http://www.hcch.net/.
